Terms of Service
1. General Provisions
These Terms of Service ("Terms") govern your access to and use of the Looping Stream website, dashboard, software features, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Service Description
Looping Stream provides a platform that allows users to upload video files, store them, automatically process and optimize them for streaming, create playlists, and broadcast them to supported third-party platforms using user-provided stream credentials or stream keys.
Available features depend on the selected plan, account status, technical compatibility, and current Service functionality. Plan limits may include, without limitation, the number of simultaneous streams, storage limits, file retention period, access to trial features, and other technical or commercial restrictions shown on the Website, Pricing page, or in the dashboard.
3. Accounts and User Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account. You must provide accurate and up-to-date information when creating and using your account.
You are solely responsible for all files, stream keys, metadata, and other content uploaded, stored, processed, or transmitted through the Service ("User Content").
4. User Content and Limited License
You retain ownership of your User Content. However, by uploading or using User Content through the Service, you grant Looping Stream a limited, non-exclusive, worldwide license to host, store, copy, process, transcode, optimize, transmit, and otherwise use such User Content solely as necessary to operate, maintain, improve, and provide the Service to you.
You represent and warrant that you have all necessary rights, permissions, and legal basis to upload, process, stream, and distribute your User Content through the Service.
5. Plans, Trial, Prepaid Balance, and Access
The Service may offer a Trial plan and one or more paid plans. Current pricing, limits, and included features are shown on the Pricing page and/or inside your dashboard. We may change plan details, pricing, or feature availability from time to time.
The Service may also use a prepaid internal account balance to activate plans, renew plans, or purchase eligible Service features. Any such balance is not a bank account, deposit, payment account, or electronic money account, and may only be used within the Service as expressly permitted.
Trial plans may include additional limitations, such as reduced storage duration, feature restrictions, watermarking, or limited access periods, as described on the Website or in the dashboard.
Access to files and streams depends on an active plan or sufficient balance, where applicable. If a paid plan expires or is deactivated, files may remain stored for up to 7 days. If a Trial plan expires or is deactivated, files may remain stored for up to 2 days. After the applicable retention period, files and related data may be permanently deleted without further notice. You are responsible for keeping your own backups of all content.
If supported by your account settings or dashboard, you may be able to purchase multiple plans or switch between plans.
6. Technical Processing and Output
To improve compatibility, reliability, and streaming stability, uploaded files may be automatically processed, transcoded, re-encoded, remuxed, scaled, normalized, or otherwise technically modified.
As a result, the processed output may differ from the original file in container, codec, bitrate, resolution, frame rate, audio settings, file size, color processing, metadata, and other technical parameters. We do not guarantee that the processed output will be identical to the source file.
File size may become smaller or larger after processing. You are responsible for monitoring your storage usage and plan limits.
7. Pricing, Billing, Payment Methods, and Renewals
Prices for the Service are displayed on the Website, Pricing page, dashboard, or checkout page. The purchase currency, total amount payable, and any applicable taxes or charges, if any, are shown before you complete the purchase.
Payments are processed through Stripe and/or through any other third-party payment methods that are clearly presented at checkout and made available by us for the relevant transaction, account, or country.
We do not store full card details. Payment data is processed by the relevant third-party payment provider.
If automatic renewal is enabled for your plan, you authorize us to charge the selected payment method or available account balance for the applicable renewal amount at the start of each renewal period, unless you disable renewal before the next billing cycle begins.
8. Cancellation, Right of Withdrawal, and Refunds
You may cancel future renewals at any time through your account settings, where such functionality is available, or by contacting support. Cancellation stops future billing only and does not automatically entitle you to a refund for any current billing period already started, except where required by applicable law or expressly approved by us.
Refund requests are reviewed on a case-by-case basis. Nothing in these Terms limits any mandatory consumer rights that apply under applicable law.
If you are a consumer and you purchase the Service online, you may have a legal right to withdraw from the contract within 14 days, unless an exception under applicable law applies. In particular, where you expressly request immediate performance of the Service or immediate delivery of digital content, and acknowledge that this may affect your right of withdrawal, the right of withdrawal may be lost or limited to the extent permitted by law.
Before initiating a chargeback or payment dispute, please contact us so we can attempt to resolve the issue. If a chargeback, reversal, or payment dispute is filed, we reserve the right to suspend or restrict access to the Service, revoke credits or balance granted for the disputed payment, and block future purchases where reasonably necessary to prevent fraud or abuse.
9. Payment Confirmations, Invoices, and Seller Information
After a successful payment, an electronic payment confirmation or receipt may be issued by the relevant payment provider. Where required by applicable law or where available for the relevant transaction type, Looping Stream may issue an invoice or other billing document using the billing details provided by the customer.

10. Acceptable Use and Restricted Content
You must use the Service only in compliance with applicable laws, regulations, third-party platform rules, and these Terms.
Users must not upload, stream, transmit, or distribute content that includes, without limitation:
- Illegal content: content that violates applicable law or facilitates illegal activity.
- Infringing content: content that infringes copyright, trademark, privacy, publicity, or other rights.
- Violence or cruelty: content that promotes violence, cruelty, or incites harm.
- Sexually explicit content: pornography or explicit sexual material, except where clearly lawful and expressly permitted by the Service.
- Hate or discrimination: content promoting hatred, extremism, or discrimination.
- Harassment or threats: threats, abuse, intimidation, or defamatory content.
- Fraud or deception: scams, impersonation, unauthorized payment use, or misleading conduct.
- Malware or abuse: code, bots, scripts, attacks, or other activity that harms the Service or third parties.
11. Moderation, Suspension, and Termination
We do not actively monitor all User Content, but we reserve the right to investigate suspected violations and to remove content, suspend streams, restrict accounts, cancel plans, or terminate access to the Service if we reasonably believe that you have violated these Terms, applicable law, third-party platform rules, or payment/risk requirements.
We may also suspend or limit the Service for technical, security, legal, operational, or risk-management reasons.
12. Disclaimer and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We are not responsible for failures, restrictions, takedowns, strikes, demonetization decisions, bans, technical limitations, or policy enforcement actions imposed by third-party platforms such as YouTube, Twitch, Facebook, or others.
We are not liable for loss of profits, loss of revenue, loss of business opportunity, data loss, or indirect, incidental, special, consequential, or punitive damages, except to the extent such limitation is prohibited by applicable law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protections.
13. Complaints and Customer Support
If you have a complaint, billing issue, or support request, please contact us first using the contact details below. We will make reasonable efforts to review and respond within a reasonable time.
14. Privacy
Our processing of personal data is governed by our Privacy Policy. By using the Service, you acknowledge that payment and transaction data may also be processed by third-party payment providers, including Stripe, in accordance with their own privacy notices and legal obligations.
15. Changes to the Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date where applicable. Continued use of the Service after the updated Terms become effective means that you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws of Poland, without prejudice to any mandatory rights and protections granted to consumers under applicable law.
