Terms of Service

1. General Provisions

These Terms of Service ("Terms") govern your access to and use of Looping Stream, including the website, user dashboard, video processing tools, file storage features, playlist features, streaming features, account balance features, billing features, and related services (collectively, the "Service"). By creating an account, signing in with Google, accessing the dashboard, topping up your internal balance, activating or purchasing a plan, uploading files, starting a stream, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company, organization, or other legal entity, you confirm that you have authority to accept these Terms on its behalf.

Tax treatment, VAT, GST, sales tax, receipts, invoices, payment documents, and the final amount charged may depend on the customer's country, customer type, payment route, currency, payment method, and applicable law. For some transactions, Looping Stream sells the account credits directly and Stripe processes the payment. For transactions processed through Stripe Managed Payments, Stripe, through Link, acts as the merchant of record and applies its own checkout terms and legal obligations, as further described below.

3. Service Description

Looping Stream allows users to upload media files, store files, create playlists, optimize media files for streaming compatibility, and broadcast streams to supported third-party platforms or custom RTMP destinations using user-provided stream keys, RTMP URLs, or other required credentials. Available features depend on the selected plan, account status, internal balance, technical compatibility, server availability, payment method, country, target platform, and current Service functionality. Plan limits may include storage capacity, number of active streams, trial duration, file retention, processing capacity, optimization availability, and other limits shown on the Pricing page, checkout page, or inside the dashboard. Video and audio optimization is included only as part of the applicable Service functionality and selected plan. It is not sold as a separate standalone paid service unless expressly stated otherwise on the website.

4. Account Registration and Security

Account registration is currently available through Google sign-in. You are responsible for your account, Google account access, login session, stream keys, uploaded files, selected platforms, and all activity under your account. You must provide accurate information and keep your account secure. You must not misuse the Service, attempt to bypass plan limits, storage limits, security systems, payment systems, technical restrictions, or use another person's account without authorization. You are responsible for any person to whom you provide access to your account. Upon request, we may assist with changing the email address linked to an account, but we may require verification and may refuse the request if we cannot verify ownership or if there are security, payment, or legal concerns.

5. Internal Balance

The Service may use an internal account balance system. In this case, users first top up their internal balance through an available payment provider and then use that balance to activate, renew, or change Service plans. Internal balance is not a bank account, deposit account, electronic wallet, investment product, or stored value service. It is a technical account credit used only inside Looping Stream for Service-related purchases and renewals. Promotional credits, bonuses, manual compensation, or other non-cash credits may have limited use, may not be withdrawable, and may be removed or adjusted in cases of error, abuse, fraud, chargebacks, or policy violations. When you top up the internal balance, the account-credit amount or payment subtotal shown for the purchase is the amount added to your Looping Stream balance after successful payment. VAT, GST, sales tax, payment-provider charges, currency conversion amounts, or other amounts added separately at checkout are not account credits and are not added to the internal balance unless expressly shown otherwise.

6. Trial and Paid Plans

The Service may offer a free trial. The current trial includes 5 full days of access, 1 GB of storage, and 1 broadcast, unless different limits are shown on the website at the time of registration. Paid plans currently include Standard, Plus, and Premium. Current prices, durations, storage limits, stream limits, and included features are shown on the Pricing page, checkout page, or inside the dashboard. We may change prices, plan names, plan limits, features, or promotional offers from time to time. Changes do not automatically affect an already active paid period unless required for technical, legal, security, platform, or operational reasons. There are no fixed Service-side limits on outgoing traffic or total stream duration unless stated on the website, in the dashboard, or required by technical, platform, security, or legal limitations. However, third-party platforms may impose their own limits. For example, some platforms, including Twitch, may interrupt very long streams after approximately 24 hours. In such cases, the Service may restart or reconnect streams where technically possible, but uninterrupted streaming is not guaranteed.

7. Plan Changes, Expiration, and File Retention

Users may change their current plan to another available plan where this option is provided in the dashboard. When changing plans, unused days of the current plan may be compensated as a discount or credit toward the new plan, calculated according to the Service logic available at that time. If your plan expires, is cancelled, payment fails, auto-renewal fails, or your internal balance is insufficient, access to files, streams, or features may be restricted, and active broadcasts may be stopped. After plan expiration, files may be stored for up to 30 days where technically possible. During this period, you may be able to restore access by topping up your balance and activating a new plan. After the retention period, files may be permanently deleted. We do not guarantee permanent storage, availability, integrity, recoverability, or backup of uploaded or processed files. You are solely responsible for keeping your own backup copies. Once files are deleted, they may be impossible to recover. If we reasonably believe that an account or content violates these Terms, applicable law, payment provider rules, third-party platform rules, or security requirements, we may restrict access, stop streams, or delete files without waiting for the normal retention period.

8. User Content

You retain ownership of files, stream titles, metadata, stream keys, RTMP URLs, and other content you upload or provide through the Service ("User Content"). By using the Service, you grant Looping Stream a limited, non-exclusive, worldwide license to host, store, copy, process, transcode, optimize, remux, transmit, and otherwise use User Content only as necessary to provide, maintain, secure, troubleshoot, and improve the Service. You confirm that you have all rights, permissions, licenses, and authorizations required to upload, process, stream, broadcast, and distribute your User Content through the Service and through any third-party platform you choose.

9. Technical Processing and Optimization

The Service may accept different media file formats, but MP4 is recommended for best compatibility and reliability. Uploaded files may be automatically processed, optimized, transcoded, remuxed, re-encoded, resized, normalized, or otherwise technically modified to improve streaming compatibility with the selected platform or destination. If a file is larger than 1920 pixels on any side, the Service may resize it down for compatibility. If a file is smaller, the Service does not guarantee upscaling. For example, a 320x240 source file may remain 320x240 after processing. The processed output may differ from the original file in codec, bitrate, resolution, frame rate, audio settings, metadata, file size, container format, visual quality, audio quality, or other technical characteristics. We do not guarantee that processed files will be identical to the source files. Processing times may vary depending on file size, file format, queue load, server availability, plan limits, platform requirements, and technical conditions.

10. Payments and Payment Providers

Payments may be processed through Stripe Checkout, Stripe Managed Payments, Cryptomus, or another payment provider made available at checkout. Available methods and payment routes may depend on your account country, current IP country, billing address, card country, currency, customer type, provider availability, sanctions and compliance restrictions, risk checks, tax requirements, and our internal payment settings. For a Stripe Direct transaction, Looping Stream is the seller of the account credits and Stripe acts as the payment processor. For a Stripe Managed Payments transaction, Stripe, through Link, acts as the merchant of record. The Managed Payments checkout or receipt may identify the purchase as sold through Link, and Stripe or Link may manage transaction-level support, fraud prevention, disputes, receipts, and order administration under the terms presented at checkout. Before checkout, we may use the billing country saved in your account together with the country associated with your current IP address to select Stripe Direct or Stripe Managed Payments. Stripe may then evaluate the billing address entered at checkout, card information, IP location, sanctions signals, and fraud or compliance signals. If information is missing, inconsistent, or not eligible for Stripe Direct, a Direct payment may be declined and you may be offered Stripe Managed Payments instead. If you choose that alternative, your saved billing country may be changed to "Unknown" so that future payments can be routed through Managed Payments. If any relevant country or payment signal is subject to sanctions or provider restrictions, all available payment methods may be disabled. You must provide accurate billing, location, customer-type, and payment information. You must not use a VPN, proxy, false address, unauthorized third-party payment instrument, or other method to misrepresent your location, evade taxes, sanctions, provider restrictions, or payment routing. We may decline, reroute, suspend, reverse, or review a payment where reasonably necessary for tax, fraud, sanctions, legal, or payment-provider compliance. We do not store full card details. Card and payment credentials are processed by Stripe, Link, Cryptomus, or the relevant payment provider. Cryptocurrency payments may be processed through Cryptomus. Crypto payments may be subject to network fees, exchange rate differences, confirmation delays, blockchain finality, compliance checks, and provider restrictions.

11. Taxes, Receipts, and Invoices

Prices, taxes, VAT, GST, sales tax, payment-provider fees, currency conversion, and the final amount charged are displayed at checkout where applicable. You are responsible for providing accurate information needed to determine the correct tax and payment treatment. For Stripe Managed Payments, applicable VAT, GST, or sales tax is calculated and added on top of the account-credit price at checkout. Stripe, through Link as merchant of record, is responsible for calculating, collecting, filing, remitting, and documenting the applicable indirect taxes for that transaction. The tax amount is not added to your Looping Stream internal balance. For Stripe Direct transactions, Looping Stream is the seller and Stripe processes the payment. The tax treatment and final amount shown may depend on the transaction, customer location, customer type, and applicable law. Receipts, payment confirmations, invoices, or tax documents may be issued or made available by Stripe, Link, Cryptomus, or the payment provider responsible for the transaction. Looping Stream does not currently provide manual invoicing through the dashboard unless expressly stated otherwise or required by applicable law.

12. Renewals, Cancellation, Refunds, and Withdrawal Rights

If automatic renewal is enabled, you authorize the Service balance system to deduct the renewal amount from your internal balance at the start of each billing period until you cancel renewal or your balance is insufficient. Where a payment provider offers recurring payments, the provider's renewal rules may also apply. You may cancel future renewals through your account, where available, or by contacting support. Cancellation stops future renewals but does not automatically refund the current paid period. Refund requests are reviewed case by case, except where mandatory law gives you a specific right. We may refuse refunds in cases of abuse, fraud, chargebacks, policy violations, excessive use, completed or substantially used services, activated plans, processed files, active or completed streams, or where internal balance has already been used. For Stripe Direct transactions, refund requests are handled by Looping Stream through Stripe in accordance with these Terms, applicable law, and Stripe's payment-processing rules. For Stripe Managed Payments transactions, Stripe or Link may provide transaction support and may approve, issue, or administer refunds, disputes, chargebacks, taxes, and payment reversals under the terms presented at checkout and the Managed Payments rules. You may contact Looping Stream for product-related support, but Stripe or Link may make the final transaction-level decision where it acts as merchant of record. Cryptocurrency payments made through Cryptomus are generally final and non-refundable, except where mandatory law requires otherwise or where we expressly approve a refund at our discretion. Any approved crypto refund may require a valid wallet address provided by the user, may be reduced by network fees, provider fees, exchange rate differences, or compliance costs, and may be impossible or delayed due to blockchain, provider, AML, sanctions, or technical restrictions. If you are a consumer with a mandatory right of withdrawal under applicable law, nothing in these Terms limits that right. However, by activating a plan, uploading files, starting processing, or starting a stream, you request immediate performance of the digital service and acknowledge that access to the Service begins immediately. Where permitted by law, your right of withdrawal may be limited or lost once the Service has been fully performed or digital content/service access has started with your consent.

13. Acceptable Use

You must use the Service only in compliance with applicable law, third-party platform rules, payment provider rules, and these Terms. You must not upload, process, stream, broadcast, distribute, or promote content that is illegal, infringing, fraudulent, malicious, hateful, violent, sexually exploitative, pornographic, defamatory, deceptive, abusive, or otherwise prohibited by law or by the rules of the target streaming platform. You must not use the Service for spam, scams, malware, phishing, unauthorized automation, payment fraud, evasion of platform bans, copyright infringement, impersonation, or activity that harms the Service, other users, payment providers, third-party platforms, or any third party. We do not monitor all uploaded content, but we may review, restrict, remove, or report content if we believe it violates these Terms, applicable law, third-party platform rules, payment provider requirements, or security requirements.

14. Third-Party Platforms and RTMP Destinations

The Service may allow streaming to platforms such as YouTube, Twitch, Facebook, and other destinations through RTMP or similar technologies. We are not responsible for actions, limits, outages, bans, strikes, takedowns, copyright claims, demonetization, stream interruptions, policy enforcement, account restrictions, or technical limitations imposed by YouTube, Twitch, Facebook, or any other third-party platform. You are solely responsible for your actions on third-party platforms, for the content you stream, for the stream keys and RTMP destinations you provide, and for compliance with the rules of each platform where you stream. Looping Stream only helps technically launch and maintain streams and does not control the policies or decisions of third-party platforms.

15. Suspension and Termination

We may suspend, restrict, or terminate access to the Service if we reasonably believe that you violated these Terms, applicable law, third-party platform rules, payment provider requirements, security requirements, or risk requirements. We may also suspend or limit the Service for maintenance, security, legal, operational, payment, infrastructure, or technical reasons. Suspension or termination may result in loss of access to files, streams, account features, internal balance use, or other Service functionality, subject to mandatory law.

16. Availability and Disclaimer

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free streaming, specific processing results, permanent file availability, successful platform connection, or compatibility with every file, codec, device, browser, network, RTMP destination, or third-party platform. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.

17. Limitation of Liability

To the maximum extent permitted by law, Looping Stream is not liable for lost profits, lost revenue, lost business opportunity, loss of audience, loss of monetization, data loss, file loss, platform penalties, account bans, copyright claims, demonetization, stream failures, indirect damages, consequential damages, special damages, or punitive damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

18. Privacy

Personal data is processed according to our Privacy Policy. Payment and transaction data may also be processed by Stripe, Link, Cryptomus, Google, or other relevant providers according to their own privacy notices and legal obligations.

19. Changes to the Terms

We may update these Terms from time to time. The updated version will be posted on this page. Continued use of the Service after the updated Terms become effective means that you accept the updated Terms. For substantial changes, we may post a notice on the website, inside the dashboard, or send a notification to registered users where appropriate.

20. Governing Law

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protections that may apply under the laws of your country of residence.
